Voting Question: Purchased a NewHome that Sits on Undisclosed Storm Drain Easement?
I purchased a new contruction home August 2006 from a builder in TN. The deed or plat neither one has anything listed about an easement on the property I purchased. The plat shows the easement on my neighbors property with her lot being larger to accomodate the addtional room needed for the easement. The easement is 15 feet wide for a large storm drain to run between her house and my property line. Recently while having a fence installed she discovered her lot was short 15 feet on the width. Noticing this she called the builder which sent a surveyor and engineer out to verify the easement location. Our houses have only 16 feet between them and with the easement being 15 it is actually on both of our lots. The easement runs at an angle from front to back and the front corner of my house and the back corner of her house both are actually sitting on the easement. The builder has already told us that he would do what ever it takes to make us happy. What should I do?
